Short-dated closeout inventory: foods, cosmetics and supplements

Short-dated closeout inventory needs category-specific handling. Most food date labels signal quality, but infant formula carries a required use-by date. Cosmetics have no federal expiration requirement, yet products regulated as drugs, such as sunscreens, do. Supplement dates must be supported by data. Act early, share dates by batch, and never relabel.

Why remaining shelf life drives price

Every month that passes removes buyers. Buyers and channels often set their own minimum remaining shelf life, so a dated product offered early reaches more of them and keeps more value, while the same product near its date may fit only a few outlets. Moving short-dated excess inventory early is also how it gets used rather than discarded.

Foods: quality dates and one firm exception

USDA's Food Safety and Inspection Service explains that, except for infant formula, product dating is not required by federal regulations, and that dates generally indicate quality rather than safety. A "Best if Used By" date indicates best flavor or quality, a "Sell-By" date helps stores manage display, and a "Use-By" date is the last recommended date for peak quality. FSIS guidance says foods not showing signs of spoilage should be wholesome and may be sold or donated past a "Best if Used By" date. That depends on proper storage and handling, and state rules, recipients and buyers may set stricter requirements.

Infant formula is the exception. Federal regulations require a "Use-By" date, and formula past that date should be excluded from any sale or donation plan.

Cosmetics: no required date, but not a free pass

FDA states that no U.S. law or regulation requires cosmetics to have specific shelf lives or expiration dates, but manufacturers remain responsible for product safety and for determining shelf life. Products that are also drugs, including sunscreens, acne treatments, and makeup or moisturizers with SPF labeling, must be stability tested and carry expiration dates. Treat drug-labeled products past their expiration date as not for resale. FDA also notes that eye-area cosmetics tend to have shorter shelf lives, so share manufacturing or batch codes and storage conditions for every cosmetic SKU.

Supplements: the date on the label must hold up

FDA's dietary supplement CGMP compliance guide says the rule does not require an expiration, shelf or "best if used by" date, but a manufacturer should have data to support any such date placed on a label. For closeout purposes, the labeled date is the reference point. Do not extend, cover or relabel dates, and list batch codes with their dates so buyers can check them.

Marketplace rules add another layer

On Amazon, unfulfillable units with an Expired reason are not eligible for FBA Liquidations. Marketplaces and buyers can set their own date and eligibility rules, so check them before choosing a route.

Short-dated inventory checklist

  • List every SKU with batch code, date type and units per date.
  • Exclude infant formula and drug-labeled products past their dates.
  • Record storage conditions, especially temperature and heat exposure.
  • Note remaining shelf life in months for each batch.
  • Check marketplace and buyer date requirements.
  • Never relabel, extend or obscure manufacturer dates.
  • Start the sale process early instead of waiting for the final months.

Selling short-dated stock through REMEX

For inventory in your own warehouse, the REMEX path is submit, review, buyer matching and sale, settlement, then pickup. Acceptance and terms are confirmed after review, and because buyers set different date requirements, one submission may be matched with more than one buyer. FAQ

Can food past its date be donated?

FSIS guidance says foods without signs of spoilage may be donated past a "Best if Used By" date, but this does not apply to infant formula past its use-by date. Storage history, state rules and the recipient's policy also apply, so confirm before you donate.

Do cosmetics need an expiration date to be resold?

Not under federal cosmetics rules, but products regulated as drugs do, and buyers can set their own date requirements.
